Atlas Limited Warranty Policy

At Atlas, we build next-generation health wearables because we believe everyone deserves clear, actionable insight into their body. We stand behind the quality of every Atlas device we ship. This Limited Warranty Policy explains exactly what is covered, for how long, and what we will do if something goes wrong — in plain language, without the fine print maze.
1. WHAT THIS WARRANTY COVERS
Occam BCI, Inc. ("Atlas", "we", "us") warrants the Atlas Device hardware (excluding the battery and any consumable sensor components) to be free from defects in materials and workmanship under normal use conditions during the applicable Warranty Period.
Coverage applies to manufacturing defects and product failures that occur under normal and expected use. If your Atlas device stops working the way it should because of how it was made — not because of how it was used — we want to make it right.
This is a LIMITED WARRANTY under the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.). It is not a full warranty. The significance of that distinction is explained in Sections 12 and 13 below.
2. WARRANTY DURATION
The Warranty Period is one (1) year from the date of original purchase by the original end-user purchaser ("Warranty Period").
To make a warranty claim you must be the original purchaser and provide valid proof of purchase — such as a retail or online receipt, or an order confirmation showing the purchase date and product purchased.
Replacement Device Warranty
A replacement device provided under this warranty is itself covered for the longer of: (a) ninety (90) days from the date of delivery of the replacement device to you; or (b) the remainder of the original Warranty Period of the device it replaced. No additional warranty period extension is granted beyond these terms.
3. WHAT IS NOT COVERED
This warranty does not cover, and Atlas will not be responsible for, damage or failure resulting from any of the following:
- Normal wear and tear over time
- Cosmetic damage — including scratches, dents, broken or bent casing — that does not affect the core functionality of the device
- Use of the device outside its specified operating temperature ranges
- Use of the device outside its specified operating humidity ranges
- Excessive fall or impact damage
- Unauthorized modification, opening, disassembly, or repair of the device by anyone other than Atlas
- Misuse, abuse, accident, or negligence
- Water or liquid damage beyond the device's rated water-resistance specifications
- Loss or theft of the device
- Damage caused by use with unauthorized, incompatible, or third-party products or accessories
- Battery capacity degradation resulting from normal use over time
- Damage from power surges, improper charging sources, or use of unauthorized charging accessories
Software issues, bugs, or performance are governed by Atlas's Terms of Service and are not covered under this hardware warranty.
4. WHAT IS NOT A DEFECT
The following are normal characteristics of the Atlas device and are not considered defects in materials or workmanship:
- Gradual reduction in battery capacity over time — all rechargeable batteries lose capacity with charge cycles; this is not a malfunction
- Minor variations in color, finish, or surface texture that do not affect functionality
Performance variations arising from environmental factors — such as temperature, altitude, or humidity — that fall within the device's rated operating specifications.
5. WARRANTY REMEDY
If you submit a valid warranty claim and Atlas determines that your device has a covered defect, Atlas will, at its sole discretion, do one of the following:
Atlas cannot repair devices at this time. Replacement is our primary remedy, and a refund will only be offered at Atlas's sole discretion when a suitable replacement unit cannot be provided.
A replacement device may be new or certified refurbished — refurbished units are tested to meet the same functional standards as new units. Upon delivery of a replacement: the replacement device becomes your property, and the defective device becomes the property of Atlas.
The remedy described in this section is your exclusive remedy under this warranty.
6. HOW TO MAKE A WARRANTY CLAIM
Follow these steps to submit a warranty claim:
- Contact Atlas Customer Support at support@atlasmankind.com and tell us what is happening with your device.
- Provide your proof of purchase (order confirmation or receipt) and a clear description of the defect or failure you are experiencing.
- Atlas Support will work through basic troubleshooting with you and determine whether your situation is eligible under this warranty.
- If your claim is approved, Atlas will issue a Return Authorization (RA) number and send you shipping instructions.
- Package your device securely and ship it to Atlas at your expense, using a tracked and insured shipping method (see Section 9 for shipping terms).
- Atlas will inspect the received device to confirm the defect.
- If a covered defect is confirmed: Atlas will ship a replacement device to you at Atlas's expense, or issue a refund to your original payment method. If no covered defect is found: Atlas will notify you, and you may choose to have your device returned at your expense or authorize Atlas to dispose of it.
Typical processing time after Atlas receives your device: approximately 15 business days. We will keep you informed by email throughout the process.
7. SHIPPING FOR WARRANTY CLAIMS
You are responsible for shipping your device to Atlas for warranty service. Atlas is responsible for shipping the replacement device (or your original device, if no defect is found and you request its return) back to you. Specifically:
Inbound Shipping (You → Atlas): You are responsible for all costs of shipping the device to Atlas for warranty evaluation. You must use a tracked and insured shipping method. Atlas is not responsible for devices lost or damaged in transit to Atlas. We recommend retaining your shipping receipt and tracking number until your claim is resolved.
Outbound Shipping (Atlas → You): If Atlas confirms a covered defect and provides a replacement device, Atlas will ship the replacement to you at no charge via standard ground shipping to a domestic U.S. address. Expedited shipping, if available, may be selected at your expense. Warranty Services, including shipping of replacement devices, is only available within the United States. Atlas does not provide warranty service for Devices located outside the United States.
No Covered Defect Found: If Atlas inspects your device and determines that no covered defect exists, Atlas will notify you. You may then request that your device be returned to you at your expense, or you may authorize Atlas to dispose of the device. If you do not respond within thirty (30) days of Atlas’s notification, Atlas may dispose of the device.
Packaging: You are responsible for packaging your device securely and in a manner sufficient to protect it during transit. Atlas is not responsible for damage occurring during inbound shipping due to inadequate packaging. Atlas recommends using the original product packaging if available, or a padded shipping box with adequate cushioning material.
8. CONSUMABLES (SENSORS) — NO WARRANTY
Consumable sensor components are expressly excluded from this Limited Warranty.
- Consumable sensors are provided "AS IS" and "AS AVAILABLE," without any warranty of any kind, express or implied.
- Atlas makes no warranty — including no implied warranty of merchantability or fitness for a particular purpose — with respect to any consumable sensor.
- Performance of consumable sensors depends on proper use within the specified parameters described in your device documentation.
If you receive a consumable sensor that appears defective on arrival, please contact Atlas Support at support@atlasmankind.com within 30 days of receipt. Any replacement provided in such circumstances is a goodwill gesture at Atlas's discretion — it is not a warranty obligation.
9. ADDITIONAL WARRANTY TERMS
Non-Transferable. This warranty extends only to the original purchaser of the Atlas device. It is not transferable. If you sell or give away your device, the warranty does not transfer to the new owner.
Void on Transfer. The warranty is void if the device is resold or transferred to another person or entity.
Pre-Sale Availability. These warranty terms are made available for your review prior to purchase, as required by applicable law including the Magnuson-Moss Warranty Act.
Your Legal Rights. This warranty gives you specific legal rights. You may also have other rights that vary from state to state. Nothing in this warranty is intended to limit rights that cannot be waived or excluded under applicable law.
10. DISCLAIMER OF OTHER WARRANTIES
EXCEPT FOR THE EXPRESS LIMITED WARRANTY SET FORTH IN THIS POLICY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the extent any implied warranty cannot be disclaimed under applicable law, the duration of any such implied warranty is limited to the duration of the express limited warranty period stated in Section 2 of this policy.
Some states do not allow limitations on the duration of implied warranties. If you live in such a state, the above limitation on implied warranty duration may not apply to you.
11. LIMITATION OF REMEDY
Your exclusive remedy under this warranty is replacement of the defective device or a refund of the original purchase price, as described in Section 5.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATLAS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE YOUR ATLAS DEVICE, EVEN IF ATLAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some states do not allow the exclusion or limitation of incidental or consequential damages. If you live in such a state, the above limitation or exclusion may not apply to you.
In all cases, Atlas's maximum liability under this warranty will not exceed the original purchase price you paid for the device.
12. STATE LAW VARIATIONS
This warranty gives you specific legal rights, and you may also have other rights that vary by state or jurisdiction.
To the extent any provision of this warranty conflicts with mandatory consumer protection laws of a particular state that cannot be waived by contract, that provision is modified only to the minimum extent necessary to comply with such law, and all other provisions remain in full force and effect.
Residents of California, Connecticut, and certain other states may have additional statutory rights under applicable consumer protection laws. Nothing in this warranty is intended to limit any statutory right that cannot lawfully be waived or excluded.
13. GOVERNING LAW
This warranty policy is governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under or related to this warranty shall be resolved pursuant to the Terms of Sale, including without limitation, the arbitration and class action waiver provisions set forth therein.
